Sally believes that the mediation process works because it removes disputes from the imposed decision making processes of court governed litigation, and instead helps the parties to resolve even the most difficult disputes in a more practical way, taking account of the real interests and needs of the parties, without the risks and costs of court proceedings. The parties to the dispute decide their own process and achieve their own solution, without a court based decision to the extent that the expressions "winner" or "loser" are replaced by parties to a successful mediation.
